Which costs are not covered by FECA?

The Federal Employees’ Compensation Act (FECA) provides comprehensive workers’ compensation coverage for federal employees. However, there are certain limitations on the right to receive compensation under FECA. Generally, coverage exclusions may include:
- Injuries that occur during an employee’s regular commute to and from work (since this is not considered within the course of employment).
- Injuries caused by willful misconduct, the intent to bring about injury or death to oneself or another, or intoxication of the injured employee.
- Conditions caused by stress or strain in the work environment unless it can be established that the work conditions are significantly more stressful or straining than the typical work environment for that type of job.
- Illnesses or diseases resulting from voluntary participation in off-duty recreational activities, even if the employer sponsors those activities.
- Pre-existing conditions that were not aggravated or accelerated by the employment activities.
It’s important to note that these are general guidelines, and each case is evaluated individually. Specific exclusions and limitations can be found in the FECA regulations and bulletins.
